LEGAL
Terms and Conditions
The rules for using AppGazers and understanding the limits of market research data.
1. About these terms
These Terms and Conditions govern access to appgazers.com, the AppGazers research workspace, API, exports and Model Context Protocol (MCP) service (together, the “Service”). “AppGazers”, “we”, “us” and “our” refer to the operator of the Service. Contact us at [email protected] about these terms, account issues or legal notices.
Read these terms before creating an account or using the Service. By using the Service after being given notice of these terms, you agree to them to the extent an enforceable agreement is formed under applicable law. If you do not agree, do not use the Service. If you act for an organization, you must have authority to bind it. You must be at least 18 and legally able to enter into this agreement.
Our Privacy Policy describes personal-information processing and available choices. Agreement to these terms does not provide blanket consent to tracking, marketing, international transfers or other processing that requires a separate lawful basis.
2. Accounts and security
Provide accurate account information, use only accounts you are authorized to access and keep your sign-in, tokens and connected clients secure. You are responsible for actions you authorize through your account, subject to applicable law and our responsibility for our own security failures. Tell us promptly if you suspect unauthorized access. We may require reasonable verification before restoring access or acting on an account request.
Do not share credentials publicly, impersonate someone else, create fraudulent accounts or bypass a suspension. You can stop using the Service at any time, revoke integrations in the workspace and request account deletion by email. Deletion and any necessary retention are addressed in the Privacy Policy.
3. Permission to use the Service
Subject to these terms and applicable feature limits, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for lawful personal or business research, including research for your clients. You may use supported exports, API endpoints and MCP tools within the access granted to your account. We reserve all rights in the Service that we have not expressly granted.
You may incorporate reasonable excerpts of our research and derived statistics into your own internal analysis or client deliverables, subject to third-party rights and any source-specific restrictions. Identify AppGazers as the source of its estimates, retain relevant limitations and do not imply endorsement. Republishing substantial portions of our proprietary database, reselling access, redistributing our exports as a competing data product or using our proprietary content to train a general-purpose model requires our prior written permission, except where applicable law gives you a right we cannot restrict.
4. Acceptable use and automated access
You must comply with applicable privacy, intellectual-property, consumer-protection, advertising, anti-spam and other laws. In particular, do not:
- Use the Service to harass, discriminate unlawfully, stalk, dox, commit fraud or infringe someone’s rights.
- Upload malicious code, attempt unauthorized access, evade rate limits or access controls, interfere with other users or overload our infrastructure.
- Harvest personal information for unsolicited messaging or surveillance, or treat a public listing as permission to contact someone unlawfully.
- Remove source or rights notices, misrepresent estimates as verified results or official store data, or falsely claim affiliation with AppGazers or a source platform.
- Use automated scraping to bypass supported interfaces or account restrictions. Authorized API and MCP automation remains subject to these terms, quotas and security controls.
Restrictions on reverse engineering, interoperability or database use apply only to the extent lawful. Nothing here prevents good-faith reporting of security issues to us or exercise of a non-waivable statutory right.
5. Our content and third-party content
We or our licensors retain rights in the Service’s software, interface, branding, editorial content, original analysis and protectable database structure. Third-party content—including app names, icons, screenshots, descriptions, reviews, trademarks, ad creative and videos—belongs to its respective rights holders. Its display or availability through an export does not grant you an advertising, publication, trademark or other reuse license.
AppGazers is independent of Apple, Google, Meta, browser stores, app publishers and connected AI providers unless a specific relationship is stated. Public availability does not establish ownership, licensing or endorsement. You are responsible for obtaining permissions needed for your use. These terms cannot expand rights that AppGazers does not hold or override a source platform’s lawful restrictions.
If you believe content infringes your rights or improperly exposes personal information, email us the relevant URLs, a description of the issue, evidence of your authority and a way to contact you. We may investigate, restrict access, correct or remove material as appropriate. This contact process does not assert that we hold a particular statutory safe-harbor status or limit remedies available by law.
6. Your content and feedback
You retain ownership of content you provide, such as saved labels, folder names, support messages and feedback. You grant us a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit and display that content only as reasonably necessary to provide, secure, maintain and improve the Service, handle your requests and meet legal obligations. Service providers may exercise those rights only as needed to perform their role. This license lasts while needed for those purposes, including lawful backup and retention periods.
You must have the rights necessary to provide the content. Do not submit others’ confidential information or unnecessary sensitive personal information. This license does not authorize selling your private workspace, unrelated advertising use, or training third-party general-purpose AI models on your private content. Personal-information processing remains subject to the Privacy Policy and applicable law.
You allow us to use voluntary product suggestions to develop and improve the Service without payment or attribution, while respecting your confidentiality and privacy rights. Do not send suggestions containing material you cannot lawfully license for that purpose.
7. Research limits and AI connections
Catalog coverage and freshness vary; source records can be incomplete, delayed, inaccurate or removed. Downloads, revenue, keyword scores, opportunities and growth indicators are modeled estimates or heuristics, not audited results, official search volumes or guarantees. Revenue estimates represent modeled gross in-app spend and exclude advertising revenue, web sales and net profit unless expressly stated otherwise. Missing information is not zero. Public ads do not establish profitability, and public reviews do not represent every user.
The Service provides research, not financial, investment, legal or other professional advice. Verify information independently before making business, publishing or financial decisions. You remain responsible for decisions and publications based on the research.
Connecting an AI assistant authorizes the scopes and tool actions you approve. Clients may read research and, where authorized, change saved items. Review permissions and outputs, protect tokens and revoke unwanted connections. AI outputs can be incorrect. Independent clients’ charges, data handling and availability are governed by their own terms; we do not control their retention of results already received.
8. Free access, credits and referrals
The Service is currently free, with usage recorded and promotional usage credit shown in accounts. Free access is not a promise of permanent free service or unchanged features. No payment or recurring charge is authorized merely by accepting these terms or receiving promotional credit. Before introducing paid access, we will disclose the applicable prices, billing, renewal and cancellation terms and obtain any agreement required by law. Nothing here authorizes retroactive charges.
Promotional and referral credit is for eligible Service usage, is not a cash balance, is not redeemable for money and cannot be sold or transferred unless an offer expressly permits it or law requires otherwise. Current account and referral screens describe reward amounts, qualification and caps. A qualified referral must meet the published conditions, including a new account with a verified email. Self-referrals, duplicate or fraudulent accounts and unsolicited unlawful promotion are prohibited.
We may investigate abuse, correct errors and withhold or reverse credit obtained through fraud, with an explanation and a way to request review. Program changes apply prospectively with reasonable notice where required and do not arbitrarily remove legitimately earned benefits. We do not introduce an expiry date for existing promotional credit through these terms. Any future paid credit or subscription needs its own clearly disclosed conditions and mandatory refund rights.
9. Service changes, suspension and termination
We may maintain, update, limit or discontinue features for legitimate operational, security, legal or business reasons. We may restrict or suspend access for a material breach, security risk, unlawful activity or a binding legal requirement. Action should be proportionate; where practical and lawful, we will explain material restrictions and allow you to seek review or remedy a breach. Immediate action may be necessary to prevent harm.
For a material reduction or discontinuation, we will give reasonable advance notice where practical and required, including an opportunity to retrieve available saved research. Ending access does not remove accrued obligations or mandatory remedies. Any paid-service refund or notice obligation remains subject to the applicable purchase terms and law. Provisions that necessarily continue, such as ownership, accrued claims and lawful retention, survive termination.
10. Warranties and responsibility
To the extent permitted by law, the Service is provided “as is” and “as available”, without guarantees of uninterrupted availability, accuracy, fitness for a particular purpose or specific commercial results. We do not exclude any warranty or standard of care that applicable law requires.
For business users, to the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, business interruption or loss of opportunity arising from use of the Service.
These exclusions do not apply to fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. They do not displace non-waivable privacy or data-protection remedies. Consumer rights and remedies remain governed by applicable law; the business-user limitations do not apply to a person acting as a consumer where prohibited or unfair.
11. Mandatory rights and disputes
Nothing in these terms removes mandatory consumer rights, privacy rights, statutory remedies, rights to contact regulators or protections that cannot lawfully be waived. If a term conflicts with such a right, the right prevails and the term applies only to its lawful extent.
Contact us to try to resolve a concern. You are not required to do so before exercising an urgent remedy, complaining to a regulator or bringing a claim where law permits. Disputes are subject to applicable law and the courts with lawful jurisdiction, including any mandatory right you have to bring proceedings where you live. These terms do not impose mandatory arbitration, a class-action waiver or an exclusive foreign forum.
If a provision is unenforceable, the remaining terms continue to the extent they can lawfully operate. A failure to enforce a provision once is not a waiver of later enforcement. Any transfer of our agreement as part of a business reorganization must respect your accrued rights and applicable notice and privacy obligations.
12. Changes and contact
We may update these terms for changes in the Service, legal requirements or legitimate operating needs. We will change the date above and give appropriate notice of material changes before they take effect where required. Changes apply prospectively and do not remove accrued rights. If a change requires fresh agreement under applicable law, we will obtain it; posting an update alone is not a substitute. If you do not accept revised terms, you may stop using the Service and request account closure, without losing mandatory rights.
